As 2019 comes to a close, we are reminded of all the good work our Local 1014 members have done throughout the year. From the Tick, Saddleridge and Getty Fire responses to our Dispatchers fielding hundreds of emergency calls for service daily, our members have bravely and selflessly answered the call of those in need.

We are blessed to work for the greatest Fire Department in the nation. All our Local 1014 members including Firefighters, Paramedics, Dispatch, Heavy Equipment, Health Haz-Mat, Forestry, Camps, and Pilots remain committed to the mission of providing world-class service to the over 4 million residents of the unincorporated communities of Los Angeles County and 59 contract cities we serve each day. 

The holidays are a time of joy and gratitude but they can also be a time of stress and for our members, a time when call loads increase and our jobs become more challenging and more demanding. That is why it is important to remind all our members to take care of each other. FLSA Lawsuit Settlement 

This week, Local 1014 members received communication that a settlement has been reached in the Fair Labor Standards Act (FLSA) lawsuit against Los Angeles County.  Local 1014 as part of the Coalition of County Unions (CCU) has been working together with the law firm of Rains, Lucia, Stern St. Phalle & Silver to move as a group our collective body of individual claims. Over the past year, Local 1014 led the communication effort with the membership and moved the filings through the Union Hall to aid claims.  The first two suits were filed on behalf of Deputy Sheriffs Thomas Ferguson and Miguel Ortega, subsequent claims were filed by our members and members of the CCU and coordinated through our outreach.  Local 1014 along with the CCU fully endorses the settlement, which will require the County to recalculate overtime from August 2015 to take into account cash in lieu of health benefits. 

What this means is that because of your union’s efforts, the County has paid or will pay a total of $27 million in recalculated overtime, $7 million of which is being paid to those in the lawsuit. No attorney fees will be paid by anyone who joined the lawsuit as the Court will order the County to pay the fees.

This has been a long fight for Local 1014 and the CCU to get our members the money they are due. (See attached letter for a full history of the lawsuit and previous Union communications on this lawsuit from 06/16/19, 10/26/18, Fall 2018 Nozzle, and 08/16/18) 

If you did not join the lawsuit, you’ve already received your supplemental payment and there is nothing more for you to do. If you joined the lawsuit, you need to formally accept the settlement by following the instructions on the attached flyer prepared by the attorneys handling the lawsuit.

Christmas Eve/Christmas Day Staffing 

As we stated last week, Local 1014 has been hard at work trying to eliminate back-to-back recalls for our members this holiday season. It is not lost our Executive Board, all of whom are also subject to recalls, the impact that our staffing shortage is having on our members and their families, especially during the holidays. We have been working around the clock to try to ensure members are not recalled both Christmas Eve and Christmas Day. 

We are pleased to announce that as a result of our effort on the Labor-Management Staffing Committee, and due in large part to the Union fighting for temporary and long-term staffing solutions, we were successful for the over the overwhelming majority of our 3,200 members.  Only eight members in three battalions have been recalled for both Christmas Eve and Christmas Day.

We are reaching out now to our Union brothers and sisters to ask that anyone who has both Christmas Eve and Christmas Day off and is willing and able to work consider volunteering for one of these individuals. We would like ALL of our members to have the opportunity to spend at least one day at home with their families.

IAFF Media Awards

                            

Local 1014 comes in BIG at the International Association of Fire Fighters Media Awards! We are pleased to announce that Local 1014 placed in all submitted categories for the IAFF Media Awards. 

Out of hundreds of entries from both the US and Canada, Local 1014 won second place for Best Public Relations Campaign (Safety Stand Down/Behavioral Health Campaign) and Best Special One Time Project (Pound for Pound, Strongest Around Poster). We also won honorable mention for our quarterly publication The Nozzle (Fall 2018 Edition). 

These awards recognize Local 1014 as a leader and an innovator in the nation for membership communication, political action, and public relations. The IAFF Media Awards recognize Firefighter Unions for their best work in communicating with their members and the public, and for portraying professional firefighters and paramedics as dedicated all-hazards responders. The IAFF Media Awards Contest helps create a greater awareness of the work IAFF members in the United States and Canada do to keep the public safe. We would also like to thank our partner Poloma Public Affairs for their work on all three winning projects.

As we approach the holiday season and get ready to fill for Christmas Eve and Christmas Day, your Union continues to work with the Department to make sure all temporary and long-term solutions for staffing shortages are in place.  This year, perhaps more than most, we have been feeling the impact of our staffing shortage. It is not lost our Executive Board, all of whom are also subject to recalls, the impact that our staffing shortage is having on our members and their families. We are working hard to try to ensure that no member works both Christmas Eve and Christmas Day.

The Union crafted a series of temporary solutions to help with holiday staffing.  We convened the Labor-Management Staffing Committee and presented our ideas and negotiated agreement on the temporary solutions for holiday staffing. We will continue to press the Department to find long-term solutions and hire more Firefighters which is the only true solution to this ongoing issue.  We will keep you updated on this as we move forward. While these temporary solutions are not a cure-all for every member, we believe that these will take care of the majority of the membership, ensure that we can enjoy the holiday with our families, and take care of those who will be working on the 24th and 25th. 

Trial Shift Schedule Change

Over the past week, the Executive Board has been discussing and debating the report given the to Board by the Trial Shift Schedule Change Committee. This issue as you all know has been the subject of much debate within our Board, at stations, and on social media over the past several months. 

Your Executive Board has always been committed to having the voice of the membership speak on this critically important issue. Our schedules affect not only our working life but our home lives as well.  A schedule change is both very personal to each member and their family and all-encompassing for every member of our Union. We do not take this fact lightly. 

The work of the committee was extremely valuable in that we saw the diversity of opinion within the membership and the need for a swift but deliberate resolution to this issue. We would again like to thank the Committee for their work and research on all schedule options and for their report to the Board. 

At our Executive Board meeting, we debated this issue at length and discussed the ongoing feedback we have had from the membership over the past several months. The Board was divided and presented multiple motions before we reached a resolution. There was disagreement on whether the committee recommendation to put forward only the 48/96 schedule change was the right path to represent all of our membership. The committee recommended only the 48/96 schedule be put out but by a very narrow vote almost even with 4/8.  Based on the report and the assessment of the membership's interest in both schedules, the Board took action to put both schedules before the membership.   

After debate, discussion, and multiple motions, the following motion was passed by the Executive Board for the ballot language to the membership: "Motion to put forward a one-year trial schedule change vote with yes or no (requires 50% plus one threshold), and secondly, if the first threshold is met, to list both 4/8 and 48/96 schedules as options for the trial and move forward with the schedule that garners the most votes for the trial." 

We believe that this vote will be the most accurate measurement of what our membership wants and will put us in the best position to fight for a change with the Department and the Board of Supervisors. We appreciate the patience that you have had during these months. We do not take this issue lightly and have made great efforts to give every option consideration. This process has taken extra time, but we believe that it is the right thing to do to ensure all voices are heard. We will be moving to a ballot at the beginning of next year. We will keep you updated as we begin that process and set dates for the ballots to be mailed out and returned.  There will be plenty of time to discuss and debate the issue before ballots are counted as we are going to give a full 30 days to vote to encourage everyone to cast a ballot.  Stay tuned as we roll this out near the end of the first week of January.

It was a historic week for Local 1014! On Tuesday, the Los Angeles County Board of Supervisors unanimously passed the LA County Fire District 911 Firefighter/Paramedic Emergency Response Measure for the March 2020 ballot. This measure will change our Department for many generations to come. It will provide the funding for much-needed relief for our staffing crisis as well as replacement and upgrading of our aging fire stations and equipment. 

We would like to thank the Board of Supervisors especially Supervisors Janice Hahn and Kathryn Barger, the movers of this motion for their innovation and continuous support. We would also like to thank Supervisor Sheila Kuehl, Supervisor Hilda Solis and Supervisor Mark Ridley-Thomas for their strong voices in support of our members and their commitment to getting the resources we need. 

We would also like to thank our 1014 Executive Board and all our partners including Chief Daryl Osby, Assistant Chief Eleni Pappas, Deputy Chief Jon O'Brian, LACoFD Medical Director Dr. Clayton Kazan, Firefighter/Paramedic Erin Regan, our Contract City officials, and our members of the business community who spoke in support of this measure for our members and our communities.  

While it is important to address the mental health side of what our members see each day, we cannot ignore the underlying issues of recalls, understaffing, deployment and lack of resources. Currently, we do not meet the national standard for staffing of the National Fire Protection Association. This has a direct impact on our ability to take care of the public and our firefighters. This measure will go a long way towards fixing those issues.

As the County has grown, we have seen an overwhelming increase in call volume and call complexity. Not since Proposition E in 1997 have we asked the voters for additional funding for our Fire Department. We have been good stewards of the public’s funds and have used them to provide world-class service to our residents. But since 1997, we have seen a dramatic shift in the scope of our emergency services, the intensity of our fire season and the use of technology as a critically important tool for providing emergency services. While our members have adapted to the growing needs of the community, we need the voters to recognize that these needs are changing for the County and our members. 

We have a lot of work to do before the March ballot and your Union will be leading the political charge to ensure that the voters understand the critical need for this funding for our members' health and safety and continued service to our communities. 

Peer Support Quarterly Training 

Today, the LA County Fire Peer Support Team hosted its final quarterly meeting of 2019 at the Dockweiler Youth Center in Playa del Rey. At the training, the Peer Support Team engaged in a year-end review highlighting the tremendous accomplishments of 2019 including the 2nd Annual Behavioral Health Safety Stand-Down, the doubling of our peer team from 70 to 140 members, and the completion of department-wide Batallion-level training for all LACOFD members. During the training, our Peer Support Team Leads held a "Peer Support Review" of the Saugus High School Shooting and discussed best practices for peer responses in the future. 

Finally, Peer Coordinator Scott Ross presented the Peer Team with the Public Safety Peer Support Association’s 2019 Meritorious Service Team Award! The national award recognizes the team’s mission of providing invaluable peer support for first responders and was presented to LACoFD last month at the national conference. While we made great strides in building the Peer Program this year, there is more work to do as we look to expand their mission and continue to break the stigma of behavioral health in the fire service.

This week members of your Local 1014 Executive Board met with the Department to work on Manual of Operations language, IPFIRS and payroll issues to administer our negotiated benefit - Compensatory Time Off (CTO). 

It took many years to get the County to agree to allow our members to bank hours worked in lieu of overtime pay.  Under the law, CTO is treated the same as Overtime (OT) for the purposes of FLSA.  We negotiated and earned the ability to bank up to 96 hours of OT as “Time on the Books” to use at a later date. 

We have worked countless hours to develop the language for our manuals that remains true to the intent of the MOU language.  We are close to completion which includes addressing Volume 2 staffing items and timekeeping issues. We cannot stress enough that words matter to protect our FLSA pay, terms of OT tracking, and assignment to ensure a fair and equitable outcome for our members. 

Some highlights in advance of the policy are: 

  • Comp Time (CT) time will be treated as Benefit Time for filling and use and all requests for CT time will be submitted on Form 38. 
  • Personnel working OT may elect to bank comp time in lieu of overtime.  For a shift, 24 hours of comp time may be banked up to a maximum of 96 hours total at any given time, and the 12 hours of premium pay will be paid.  Time and one half will always be the rate we earn OT or CTO and this was key in our negotiations for FLSA purposes. 
  • When a member burns a CTO Day, the member working cannot bank CTO again on that day.  This is important and prevents compounding a CTO day in perpetuity.  
  • CTO days may only be banked when working in your rank, no work down CTO banked days, and when members promote or retire they will be paid their CTO hour balance, and all hours of CTO will be recorded and treated as hours worked for the purposes of FLSA and FD-7 Recording just as if they and literally they are OT hours. 
  • CTO days being filled will be treated like benefit days and will be filled with available personnel only, and not garner recall for fill.  They will be treated the same as V, SP, and F days.  The likely IPFIRS codes will be CT for Comp Time Banked and ST for CTO taken.   

On the implementation side, it will remain fairly simple and includes mechanisms to prevent abuse. We will monitor to ensure all members are using the benefit appropriately and that the Department is managing the use fairly.  We hope to have a good track record of use by the time we negotiate again and increase the number of days on the books. 

We want to thank Deputy Chief William Mc Cloud and Assistant Chief Dennis Breshears for the long hours spent at the Union Hall to get this tedious but important work done so we can begin to enjoy this benefit.  The fires have died down and we are aggressively working to handle some follow up work on our manual language. We expect to have this item done before the holidays.  

I have asked the Chief to help me to prioritize and finish some critical working and pay items for a Merry Christmas year-end finish. We will have more info on those later but know that CTO is one of those items to help us as we deal with the staffing shortage and year-end wildfires.

As we face the day after the horrific events at Saugus High School, we are reminded of the importance of our children and families. Our thoughts and prayers go out to the victims and their families of the Saugus High School shooting.

We have over 600 IAFF members living within a ten miles radius of the shooting. We also had several members whose children attend Saugus High School. This incident was close to home for many of our members and for our fire service community, we are thankful that all our members and their families are safe.

Our LACoFD Peer Support Team Lead Jake Windell and the Labor-Management supported Peer Support Teams were at the incident command post leading the effort to administer critical behavioral health support to our families, the community and our first responders as we process this tragedy. Our Peer Teams were able to respond quickly and effectively to this incident due to the structure that we have through our labor-management Behavioral Health Program. As we work to begin the healing process for the victims, our members, and the community, we would like to thank the LA County Department of Mental Health for their assistance and Supervisor Kathryn Barger for her quick response to this tragedy. Additionally, we would like to thank all our IAFF partner locals who reached out, many of whom have benefited from our peer support resources, to assist our members. 

California Joint Apprentice Committee (Cal-JAC) 15th Biennial Conference  

Local 1014 was proud to be a participant in and a sponsor for the 15th Biennial Cal-JAC Conference this past week. Your Local 1014 Executive Board along with our management partners participated in a two-day intensive seminar on topics ranging from leading teams under pressure to understanding unconscious bias. This conference offers an opportunity for labor and management to discuss critical issues, find solutions and engage in collaborative learning for the benefit of our members and our communities. 

At the conference this year, President Dave Gillotte, Co-Chair of the CA State Behavioral Health Task Force, worked with the task force on criteria for departments across the state to maintain compliance with the newly signed AB1116 Peer Support Bill. Additionally, our own Peer Support Coordinator Scott Ross hosted a seminar on building a behavioral health team using our LA County Peer Team and their incident responses as a model.   

A collaboration of two strong and influential forces, the Cal-JAC is co-sponsored by the Office of the California State Fire Marshal, representing management, and the California Professional Firefighters, AFL-CIO, representing labor. This partnership of management and labor creates a balance that benefits California fire departments, firefighters and ultimately the communities in which they serve.

Local 1014 was proud to be a part of continuing the tradition of improving the quality of education and training within the fire service and setting a professional standard for firefighters throughout the state of California. The work we accomplished this week will be seen not only by our current members but also by our future members as we work to create a more diverse and inclusive fire service.

This week, Local 1014 was proud to nominate the Los Angeles County Fire Department (LACoFD) Peer Support Team for the Public Safety Peer Support Association’s (PSPSA) 2019 Meritorious Service Team Award! The national award recognizes the team’s mission of providing invaluable peer support for first responders. Congratulations on winning this prestigious award! 

The LACoFD Peer Support Team is truly the gold standard for peer support in the Fire Service. The LACoFD Peer Support Team is unparalleled in its commitment to the mission of providing behavioral health services to the 4,000 first responders within the Department, including our lifeguards and civilian personnel, and first responders nationwide. Whether it is debriefing after a traumatic incident, dealing with family issues caused by stress on the job, the loss of a loved one, or just the cumulation of stress, our Peer Support Team members are available 24/7 to help our members get healthy and get back to 100%. 

Whether it is fighting for critical funding for the Behavioral Health Program or assisting the Peer Leads with their daily needs, Local 1014 is committed to the health and safety of our members and their families. Special thank you to our Los Angeles County Fire Department Pipes and Drums for a great opening ceremony and to Dr. Mynda Ohs, Fully Involved Life, for always supporting our members!

Local 1014 was proud to join Fire Cheif Osby, the Executive Staff, and LACoFD to support the first all-woman crewed Lifeguard Baywatch rescue boat as they escorted the all-woman crewed Maiden as she begins her sail around the world! 

The crew of The Maiden tour the world raising awareness and funds for girls' education and empowerment! Learn more about their mission at www.themaidenfactor.org. The historic Lifeguard Baywatch rescue boat was crewed by LACoLA Members Captain Dani McMillon and Ocean Lifeguard Specialist Lauren Dale. 

We are committed, together with our LACoLA and Department partners, to increasing diversity and inclusion with the Department and continuing the mission to have our members be a reflection of the communities they serve. We were proud to be part of this historic moment for our Department! Special thank you to the Board of Supervisors for their continued support of the men and women of Local 1014 and LACoLA!

What a week it has been for our members and their families. Once again, we have seen this week that the "new normal" of a more intense and longer fire season is real for California and for Los Angeles County. From fighting multiple wildland fires to battling several large structure fires, while simultaneously staffing all our stations and responding to calls, our members have stepped up and shown that we are the finest Department in the nation. 

As we all recover from the intense work and get ready to roll in November, Local 1014 will back at it on the heels of the Paramedic Firefighter Class with pressure to continue the hiring we so desperately need.  It is apparent that the HR and candidate processing folks are understaffed and are out of touch with the operations side of the staffing situation. They are not at all aware or connected to the staffing crisis we feel.  We are addressing that shortfall as we move forward to rapidly hire and staff our vacancies.  Thank you to the Ops Chiefs who continue to partner with us and work to get this handled.  

Thank you for your continued commitment to our communities and for the professionalism and dedication you all show each day. Local 1014 Strong!

REMINDER: Public Education Outreach 2020 

                                                   

As you have all seen by now, the Department is engaging in a public education campaign regarding our need for resources and staffing in our Department. It is vital that in the coming months we all participate in the outreach effort. Educating the public and our communities about the need for resources is a crucial part of our efforts to get more funding for our Department. Use the resources in your stations, but most importantly tell your stories. Tell your stories to our communities about the effects of recalls on your families. The most critical piece of this education effort is you. 

LACERA Pre-Retirement Classes at Local 1014

Local 1014 will be hosting retirement classes for our members. We are encouraging those over 50 years old to attend for the best information about the retirement process.

This is a full day of retirement training giving you all the tools for a successful retirement.

  • Find out your monthly pension amount
  • Learn how retiree healthcare works and which medical plans are offered
  • Hear about social security and how it relates to your pension
  • Get insight into selecting your retirement date
  • LACERA and Empower (457 Plan Administrators) will be there

Classes will be held at the Local 1014 Union Hall, 3460 Fletcher Ave., El Monte and begin at 9 AM to 1 PM. All ages encouraged to attend and spouses are welcome!

DATES: Tuesday, November 5th(C Shift); Wednesday, November 6th(A Shift); Thursday, November 7th(B Shift).

Finally, we know that this weekend is a big weekend for parties and certainly a very busy weekend for our Department. Please remember to celebrate responsibly. DONT DRINK AND DRIVE! Get a designated driver, a room, a cab, an Uber or Lyft, but do not risk your life and the lives of those around you.  Stay safe and take care of each other.

As the week begins with another massive blaze, we want to again thank all our members, Firefighters, Dispatchers, Pilots, Forestry, Fire Prevention, Wildland, and Health HazMat Personnel, for their tireless commitment to our communities. We would also like to thank our members working in stations across LACounty providing emergency services to 4 million residents throughout our unincorporated communities and 59 contract cities.


We have had an extraordinary few weeks beginning with the Saddleridge Fire, the Tick Fire and now the Getty Fire. We are also facing unprecedented winds over the next few days reaching up to 70 miles/hour. On top of all of it, we are approaching Halloween, which is also one of the busiest days for first responders all year long. We know that you are tired, you are spent from the recalls and the promise of more to come as we enter this week.


Every day we are reminded how truly unique Local 1014 is and how much our members do for not only the 4 million residents that we serve but also for our surrounding communities. When there is a need, we answer the call. We do more with less and we do it better than anyone, but that shouldn't be the case. Your Local 1014 Executive Board is continuing the fight to get more resources and more staffing with increased classes over the next year to lessen the burden. 


But this strain is not just about our membership, it is also about their families. Spouses, children, and families who make the sacrifice right along with our members each day. To all our families, thank you for your support of our mission and for your support of all our members as they work to protect lives and property.
