This week, we continued mediation with the County on the COVID vaccine mandate. Mediation is slow going but we are still continuing to move toward a path for exemptions and accommodations. Mediation is confidential, but we will continue to update you when we have more information to share. While this fight goes on at the bargaining table, we still have our members out there fighting every day to protect the public, just as they have been for the past two years. Our members protected the communities of Los Angeles when there was no vaccine, putting their families and themselves at risk. Thank you for maintaining solidarity as your Union Board continues to work on behalf of all members. 


Peer Support Training at Local 1014's Union Hall

Earlier this week, Local 1014 hosted Peer Support Training at the Union Hall. This week, we added 45 outstanding new peers to our team. We are proud to say that we now have over 200 IAFF-trained Peers Support Members on our team making it the largest team in the nation! 


Special thank you to our Peer Support Coordinator Scott Ross and our Mental Health Clinician Dr. Steve Froehlich for continuing to drive excellence in our Peer Program and expand our resources for the benefit of our members, families, and all in the fire service. 



2022 Shift Calendars COMING SOON!   
This year, in preparation for our upcoming 48-96 Trial Shift Schedule Change, we will be printing a one-year calendar with the Kelly Shift Schedule on one side and the 48-96 Shift Schedule on the other side. While we continue to push for the implementation for the trial, we want to be sure you and your families have the tools you need to plan for next year.
 
Our members will be receiving the following calendars: 
  • Active Members – Two (2) large 56-hour shift calendars
  • Dispatchers – Two (2) large Dispatch Schedule Calendars
  • Retired Members – One (1) large 56-hour calendar 
 
We expect the calendars to arrive early next year. Until then, you can download a printable copy of the calendars on the 1014 website. Following the one-year trial, we will resume printing two-year calendars for all members.

Local 1014 Keeping Our Local Elected Officials Engaged  
 

One of the most critical things your Local 1014 Executive Board does for our members and our profession is to engage in political action on behalf of our interests. But political action is not always about elections, it is also about keeping our local elected officials from every level of government engaged with our issues and our needs. 

Vice President Kurt Kobler met with Assemblymember Phillip Chen (R) this week to discuss the ongoing needs of our members at the state level. Assemblymember Chen is one of the champions for our Firefighters and our profession as we continue to fight for more resources for LA County. Thank you Assemblymember Chen for all you do to help our members and their families.

COVID-19 Vaccine Mandate Negotiations Update 
This week, the LA County Sheriff penned a letter asserting potential security and medical data concerns with Fulgent, the contracted laboratory and service provider for LA County.  It is worth noting that Sheriff himself was supporting registration with Fulgent and the weekly testing for unvaccinated Deputies as late as last week.  We are very interested in any additional information that may have come forward from the meeting he and the County had with the FBI. 

In his letter, the Sheriff indicates these concerns were given to him in a meeting with the FBI on November 26, 2021.  While the letter has no data or formal reports from the FBI, it has certainly rocked confidence in the procedural and contractual obligations negotiated between Fulgent and the County.  As you are aware, the County Coalition of Unions (CCU) and the County held three separate meetings to renegotiate terms and conditions of consent forms, agreements for excluding DNA samples in testing and ensuring data security with the US hosted and protected systems in place.  Local 1014 was the last Union to hold our members from registering if they had not already done so until these meetings were completed. As we, and almost every other Union, have indicated they would not have been our choice of contractor, but they were the County's choice. See the County of Los Angeles response to the issues raised with Fulgent below. 

As a result of this development and the impact on not only our members but the members of every Union in the CCU, we convened an emergency meeting with the County to discuss this letter and the concerns raised by the Sheriff.  President Gillotte and your bargaining team members put forward four simple suggestions that were adopted by all Unions in the CCU and sent in a letter to the County on follow-up.  We requested 1) alternatives to Fulgent for registration and testing, 2) the tolling of any proposed discipline for any members not registered, 3) any facts and minutes and/or data from the FBI meeting be shared with the Unions, and 4) a confidential meeting between the County, the CCU, and the FBI under the protection of privilege by the attorneys to view any information that cannot be shared with the public but is germane to our bargaining and impact on our members' medical property and data security.  

We also met with the Department in our ongoing conversations with Interim Fire Chief Marrone and Deputy Chief Breshears in dealing with all of the COVID-19 mandate impact items.  We have put forward a proposal for temporary tolling of any proposed discipline or skelly meetings for any members who have not registered with Fulgent, any members who are hesitant to test in the ring testing or periodic weekly testing can provide their own PCR test from a certified testing facility, and the agreement for coverage of time off if positive and quarantine agreement items will remain in effect with the outside test results as compliance. 

In addition, we have requested the Department to evaluate longer-term alternatives for both testing and data hosting for our personal information in perpetuity.  We will keep you updated on these items as both the CCU and Department talks continue.

Local 1014 Letter Regarding Sheriff Fulgent Accusations and Concerns
For now please stay the course and call the Union if you are met with any resistance to our temporary plan for testing.  The testing is to also keep our members safe and our families safe when Covid does strike any of us.  We take seriously not only all we are working on with regard to the mandate, but also as we have consistently provided, our support for the vaccine, periodic and ring testing, safety gear and procedures, and all that we can do to keep our members and families safe.  There is ground for all of this to co-exist reasonably.  We look forward to a communique from the Department on the situation and a temporary agreement to help us all navigate this new development.  


Meeting with Secretary of Labor Marty Walsh


President Gillotte along with other Presidents of the LA County of Federation of Labor Unions met with Secretary of Labor Marty Walsh and Deputy Secretary of Labor Julie Su at the LIUNA Labor Hall.  LA FED Secretary-Treasurer Ron Herrera using his experience with Teamsters, help set the meeting so Labor Unions could discuss directly with the Secretary and his Deputy issues affecting Los Angeles County workers. 

President Gillotte tackled the infrastructure bill and moving federal money to California and Los Angeles County to not just provide valuable jobs but also tax and revenue to the County which helps our economy both directly and indirectly.  President Gillotte is a Vice President on the LA Federation of Labor Board and has been involved in Los Angeles County revenue and jobs recruitment for many years.  This work is critical to the booming California business economy that feeds the state and county.   

Also discussed were the positive impacts of President Biden and Secretary Walsh’s recommendation to leverage transportation grant monies due to California against the PEPRA violations in the transportation builders contracts.  This is a positive shoring up of our position on the California Rule protecting our pensions in California and will aid our court and political cases for such a position.  We are an issue-based Union and on this issue, we will be with team Biden / Walsh to protect our pensions.  This is very timely as we also look to combat a pension assault initiative that is in the works for next June. We will have to work to combat any and all efforts to erode our pension security.  President Gillotte also thanked Secretary Walsh who hails from Boston as the Mayor who took care of the Boston Firefighters including our own General President Ed Kelly, for the work on the firefighter cancer registry and PFOS legislation to keep firefighters safe and to help battle cancer in our profession.

We would like to thank Supervisors Kathryn Barger and Janice Hahn and the 5 votes that continue to help Local 1014 members apply pressure and ensure accountability with the Department in our quest to protect and build our mental and physical health resources.

The Sierra Incident and the impact on not only our membership and families but on the Fire Service in US and Canada demands our continued work to develop our Peer Support and Leadership Training as well as hiring an occupational health doctor who will be a labor/management doctor to strictly take care of our members physical and mental health integrated with our IAFF Wellness Fitness Programs and Peer Support Programs.  This allows our final exit from County OHP as the medical authority over our members care and fitness for duty issues.  We have been working on this for many years and with the sense of urgency and also driven commitment as a result of the Sierra Incident and our previously high suicide rates, we thank the Interim Fire Chief Marrone for his continued push to get this done and leave our future brighter than before. 

Also thank you to the Peer Support Team Leads and Dr. Steve Froehlich for the continued guidance in how we resource and build out our program which has now become the premier Peer Support Team in the nation for the IAFF.

The ET-552 was issued yesterday announcing the establishment of the Wellness Division. While we are grateful for the efforts of the Department, we are once again in a situation where management is disconnected from the needs of the members. The Union is working to ensure that all members that need Behavioral Health services are not stigmatized by the labeling of those services and are able to go to a neutral location where they feel safe to heal. Unfortunately, ET-552 did not properly relay this message. The Union will be working diligently with our Peer Team to ensure that the behavioral health resources for members are appropriate and work to break the stigma within the Department and the fire service. More on this as we work to find a new location for the Wellness Division and find the right culturally-competent people to staff it.

FRIDAY UPDATE

This week, we received the news that Chief Osby will be going off on leave beginning on Monday. Our thoughts are with him and his family as he works towards a speedy recovery. As we transition leadership, we want reassure the membership that we will not have a break in momentum our items. We have many important issues in play and we cannot and will not lose momentum.  

President Gillotte spoke with Acting Chief Marrone to discuss several critically important items for our membership like: the COVID vaccine mandate, Paramedic Assessment Units, staffing, promotions and hiring and the 48/96 trial schedule shift change.  We have rough waters to navigate ahead, but your Union is committed to staying the course for all of these items as we work to improve working conditions for our members.  We also met with the CEO and The BOS as we navigate this transition and everyone is up to speed on what we are working on and where we are going.  We look forward to Acting Chief Marrone setting his team and getting back to work on the items we have been negotiating and working on.  

 
 
PARAMEDIC ASSESSMENT UNITS 

We have seen this many times over the years, where an idea happens at the top without any thought of foresight into how it affects the day to day working conditions of our members. The implementation of the Paramedic Assessment Units is a meet and confer issue. The Department did not meet with the Union on this item prior to its implementation. This is a violation of the MOU. 

JOB ACTION: We are asking members, if you are requested by your supervisor to do anything with the equipment arriving in the stations, immediately ask for a written request for that order and call your Union representative. 

We have a meeting next week with the Department where we will be discussing the issues surrounding the implementation of these units and the Department's violation of the MOU. Stay tuned as we work to ensure that our members are protected.

Finally as we close this week’s work out, sometimes the simple things in our Fire Family Lives are the best in staying together and finding peace.  Local 1014 and the Los Angeles County Fire Department have had a long standing relationship and love affair with the Los Angeles Dodgers and they have helped us in our times of need.  

We want to congratulate the LA Dodgers on their amazing victory in the West Coast World Series against the San Fransisco Giants.  The two best teams in baseball with the best records battled valiantly, and our very own Los Angeles Dodgers move on to play Atlanta in the next series as we work to unite the west coast in what is not only a game, but especially during these times, a place of family and solidarity.  Let’s Go Dodgers!

As we stated last week we are beginning bargaining for our 601/602 BU Firefighters series members. At the top of our proposal is Plan C enhancements to counter the PEPRA retirement reform. Bargaining for our wages, hours, and working conditions is at the core of our mission to protect our members families. This session will begin all bargaining for 2022. We will continue to update you as we work to get our members the pay and recognition they deserve.  
 
STATE LEGISLATIVE VICTORIES 

This week, we had great news from the Governor’s office as Governor Newsom signed all of our Firefighter sponsored bills into law. These bills area testament to our successful political action program both at the local and state level. Each year we have successes because we continue to engage and work with the people making the decision to ensure that our Fire Personnel are at the top of the list for legislative priorities. Political action is the power powerful tool we have to affect change for our members working conditions. See a list of the bills below. 
 
AB 450 (Gonzalez) – Paramedic Disciplinary Review Board 
Status: Signed by Governor  
AB 450 sets up an independent board comprised of four working paramedics, one emergency room doctor, and two members of the public, to make final determinations regarding appeals of paramedic disciplinary matters. Currently, the state EMSA Director has virtually unlimited power to deny, suspend or revoke a paramedic license, or put a license holder on probation for acts related to their role as paramedics. This bill will bring impartiality into the current system of licensure discipline, and assure California’s paramedics that they will receive fair due process. 
 
This bill is particularly significant for Local 1014 as it represents many years of hard work and dedication from our Executive Board. This fight began with our own former Vice President Dave Morse and current Director Pat Dolan fighting against double jeopardy for our Paramedics. Both Directors along with Director Jason Cervantes have served on the California Professional Firefighters EMS Committee and have been a major part of moving this bill forward. This is the first major step to reform the disciplinary system for our people. Thank you to all our Local 1014 Board Members who have fought to make this bill a reality and create a standard of discipline that makes sense for our members. 
 
AB 389 (Grayson) – Ambulance Services  

Status: Signed by Governor
AB 389 clarifies the existing authority of the “Fire Alliance Model” in which a county can contract with a fire agency for emergency ambulance services when that fire agency provides those services through a subcontract with a private ambulance provider. This model has been successful in keeping control of EMS within the fire agency and out of the hands of the private ambulance provider, and providing cost-effective solutions. Contra Costa County successfully piloted this program with the support of Contra Costa County Fire Protection District and Contra Costa County Professional Firefighters, Local 1230. Additionally, AB 389 codifies new transparency and workforce protections applicable to counties and fire agencies that elect to enter contracts for emergency ambulance services.
 
SB 278 (Leyva) – CalPERS: Disallowed Compensation  
Status: Signed by Governor
A number of retired firefighters and other public workers have been hit by huge bills and retroactive take-backs from CalPERS, citing overpayments that were no fault of the employee. SB 278 closes this loophole, requires the employer to make the retiree whole, while also implementing procedures at CalPERS to prevent future errors.  

AB 845 (Rodriguez) Disability Retirement: COVID-19: Presumption
Status: Signed by Governor
This bill, until January 1, 2023, creates a presumption that would be applied to disability retirements on the basis, in whole or in part, of a COVID-19-related illness. It requires the presumed the disability is a result of the member’s employment. The bill would apply rebuttable presumption to members employed in specified firefighter, public safety officer, and health care job classifications, or their functional equivalents, and to members in other job classifications who test positive for COVID-19 during an outbreak of the disease at their places of employment, as defined.

SB 817 (Senate Governmental Organization Committee) State Board of Fire Services Ex-Officio Designees
Status: Signed by Governor 
Through a committee bill, would allow the ex-officio members (State Fire Marshal, CalFire Representative who is not the SFM, Board Chair of the CFF-JAC and Directors of OES) of the State Board of Fire Services to select designees to attend meetings as their representatives.

TIM DRAPER INITIATIVE – ATTACKS ON FIREFIGHTER UNIONS 

We have seen it across the country and now we are seeing it here in California—attacks on our right to unionize and collectively bargain for fair wages, hours and working conditions. Last month, Tim Draper, a venture capitalist, filed an initiative to end all public employees’ rights to bargain. The initiative states: “No public employee shall have the right to form, join, or participate in the activities of a public employee labor organization for the purpose of representing said employees on matters of employer-employee relations.” 
 
Our members have faithfully served the public throughout the most significant pandemic in a century. They deserve more than to have their rights stripped away to bargain. Make no mistake this initiative strikes at the very heart of our rights as employees to band together to bargain. Together with our partners across the state and throughout all public sector unions, we will be aggressively fighting this initiative. We will keep you updated as we closely monitor this initiative and fight to protect our rights.

COVID VACCINE MANDATE 

Your Union continues to fight for fair bargaining over the COVID Vaccine Mandate. Whether you are vaccinated or not, we need to stand together to ensure that we do not lose any of the protections and rights for which we have fought so hard. Our UNITED stance is that we do recommend that you get vaccinated, but we are 100% against mandatory vaccinations.

We ask you to refrain from registering with Fulgent and the County. We have filed formal impasse over the County's failure to complete bargaining before implementation of the policies. President Gillotte, along with our Negotiating Team, Vice Presidents Lew Currier and Kurt Kobler and Directors Tony Carcioppolo and Chris Reade are working to keep the communications open regarding the selection of a mediator. 
 Impasse procedures wont give us a final result but they will help to get valid information like our request for antibody testing and natural immunity verified and back at the bargainiing table to reach agreement. 

Regardless of your stance on the vaccine, this is an issue of fair bargaining. We need to have solidarity for the sake of our future bargaining process. We cannot set the precedent that it is okay to circumvent our rights. Once again if your supervisor asks you to register or fill out any form, respectfully ask that they issue the request to you in writing. If you are pushed to fill out the form, respectfully ask to contact your Union representative. Use the following phrase if pushed: "My Union is currently bargaining accommodations for this item. If this discussion could in any way lead to my being disciplined or terminated, or affect my personal working conditions, I respectfully request that my union representative be present."

If you have medical and/or religious or moral objections, the legal exemptions are in place and you will have Local 1014 representation to navigate that process once adherence to any compliance is in place.

As you read yesterday and will see today as the County continues to roll forward with the mandated plan as proposed by the County with their forms and policy updates. We ask you to refrain from registering with Fulgent and the County and wait for the Union and the CCU to give direction based on our ongoing bargaining over the impacts of such a plan.  We have filed an impasse motion at the bargaining table over the County's failure to complete bargaining before implementation of the policies. This will engage a third-party mediator. 

We want to be clear, regardless of your stance on the vaccine, this is an issue of fair bargaining. We need to have solidarity for the sake of our future bargaining process. We cannot set the precedent that it is okay to circumvent our rights.

Once again if ordered to comply with the policy, kindly follow these instructions. 

If your supervisor asks you to register or fill out any form, respectfully ask that they issue the request to you in writing. If you are pushed to fill out the form, respectfully ask to contact your Union representative. You will notice that the medical and religious exemptions are in place in the policy. While we have additional issues we are bargaining over, we have made great progress on the implementation of those exemptions.  Each and every word in policy matters, and the procedures of non-compliance matter.  We will continue to bargain. We have two issues that remain in the CCU Counter-Proposal relating to antibody and natural immunity once the CDC and FDA get on board and also alternatives to vaccination using safety gear and testing that have not been embraced.  These items are complex and detailed but we continue to push these items on behalf of our members. 

It is important to know also that these proposals and efforts from the Board of Supervisors (BOS) are driven by the public input to their offices.  The residents we serve want a safe workforce entering their homes, and we want a safe work environment for our members.  The COVID vaccine is one of the most valuable tools to ensure both our members' safety and the safety of the communities we serve.  We recommend our members get vaccinated and utilize all safety gear when operating in the field.  We worked very hard to get priority when the vaccines first came out, and we will always put our members at the front of the line when it comes to acquiring the gear and tools to stay safe when it comes to communicable diseases.  If you have medical and/or religious or moral objections, the legal exemptions are in place and you will have Local 1014 representation to navigate that process once adherence to any compliance is in place.   

We have had many members and their families raise issues with us asking about our support for the vaccine and our acknowledgment of the impact it has had on our members and our families.  We are aware and remind all that we have had over 55 IAFF Firefighters die of COVID and over 400 Police and Sheriff Officers have died of COVID nationally in the last year and a half.  We also understand that many of our members have lost family to the disease.  We have a significant number of our members off with long COVID issues and some that will battle to get back to work.  This is a serious disease and the impact on our members and communities is of primary concern to the Union.  While we oppose the mandate, we believe providing alternatives to the mandate will net more vaccinated members and safer working conditions.  Such alternatives include incentives, the use of anti-body and natural immunity for those who have had COVID, as well as testing alternatives. We are pushing hard with our Labor partners to embrace these areas as well as other medical best practices as medical advances continue to evolve.  

Finally, as we navigate this volatile issue we once again ask our members to be kind to each other, to empathize and understand all views and opinions on this issue as we work to get to the finish line together.  There are no enemies between us, and different perspectives and thoughts on the issue are rich and can be positive if we stay bound by facts and realities of law and best practices for the health and safety of our members and our communities.   

Local 1014 and the CCU back at the Bargaining Table 

While the COVID vaccine mandate has certainly taken the headlines the past couple of months, we have many other important items of business in progress on behalf of our members.  As always, there is perhaps no greater item than our contracts. 

We are moving to form Fringe Benefit proposals through the Coalition of County Unions (CCU).  We just finished and signed a 9-month contract that had a 2.5% increase in medical premium contribution, COVID bonus, and a new holiday.  To prepare and begin bargaining for this short term, our proposals will be crafted and sent to the County by December of 2021. 

In addition, we have sent to the County our letter to officially open the contract table for Salary MOU’s for 601 and 602 our Firefighter series.  This will begin the bargaining season for all units for 2022.  We have been preparing our proposal and once again at the top of the list and priority for any work is any and all movement to achieve Plan C enhancements to counter the PEPRA retirement reform impacts.  We are excited to get to work and grind to get a fair contract for our members and once again continue to progress in salary and benefits.  We will update the membership as we formalize the table and the meetings with the County.  

Fire Season 

Our members continue to work hard to protect our communities as brush fire season is in full swing and major incidents like the Avalon Incident and the El Sereno Incident occur throughout LA County.
